A Pioneer in the CBD Industry

Within six months of that announcement, we activated over 1,200 merchant accounts and partnered with six of the largest and most trusted high-risk payment processors and sponsoring banks. By December 2020, KJ Proweb had provisioned over 2,000 merchant accounts for businesses and entrepreneurs in the hemp/CBD industry. 
New federal legislation signed in November 2025 (P.L. 119-37) is set to fundamentally restrict the hemp and CBD market, effective November 12, 2026. This law, part of the FY2026 agriculture appropriations act, redefines “hemp” to strictly limit total tetrahydrocannabinol (THC) concentration and bans many currently popular intoxicating hemp products, such as Delta-8 and THCA flower, by closing the “loophole” created by the 2018 Farm Bill.| DLA Piper]
 
Key changes and implications for hemp flower and CBD include:
 
  • “Total THC” Definition: The new law changes the definition of legal hemp from 0.3% delta-9 THC to 0.3% total THC (including delta-9, THCA, delta-8, and other isomers) on a dry weight basis.
  • 0.4mg Per Container Cap: Final consumer products are capped at no more than 0.4 milligrams of total THC per container. This strict limit is expected to make many full-spectrum CBD products (oils, gummies, tinctures) illegal, not just intoxicating ones.
  • Ban on Synthetic/Unnatural Cannabinoids: Cannabinoids that are not naturally produced by the cannabis plant, or that are synthesized outside the plant (e.g., converted Delta-8, HHC, THCO), are excluded from the definition of hemp.
  • Impact on Smokable Hemp/THCA Flower: THCA flower, which has been sold as legal hemp because it contains less than 0.3% delta-9 THC, will be considered illegal “hot hemp” or marijuana because the THCA content will exceed the new 0.3% total THC limit.
  • FDA Mandate: The FDA is required to publish, within 90 days of enactment, lists of naturally occurring cannabinoids, THC-class cannabinoids, and cannabinoids with similar effects, while also defining “container”.
  • Transition Period: These restrictions do not take effect immediately, allowing a one-year grace period until Nov 12, 2026, for the industry to adapt.
 
Potential Future Actions:
Due to the expected severe impact on the hemp industry (some estimates suggest 95% of products could be affected), there are ongoing attempts to delay or alter this law. Legislation (such as the “Hemp Planting Predictability Act”) has been proposed to delay the implementation by two years to 2028.
