Merchant Payment Readiness Assessment & Compliance Audit

This form is to assist merchants selling hemp-derived CBD, hemp-CBD gummies, minor cannabinoids, vape pens/cartridges and other hemp consumables meet federal regulatory compliance guidelines.

How to use this form. Sections 1–3 capture the merchant profile. Sections 4–10 are the compliance audit — mark Yes / No / N/A for each item and note where the supporting evidence lives. Section 11 records the readiness rating. Section 12 is the action plan and eDebit recommendation. This is a payment- and compliance-readiness review. It is not legal advice — see the disclaimer at the bottom.

1Merchant Profile

Accurate, consistent information here is the foundation of clean underwriting — the processor should always receive an honest, complete picture of what the merchant is and what it sells.

2Product Category & Vertical

Check every category the merchant sells in. Each carries a different regulatory and underwriting profile. KJ ProWeb sorts merchants into three payment programs rather than lumping everyone into "high risk."

    32026 Regulatory Exposure Screen

The federal hemp definition changes at the end of 2026, calculating total THC — including THCA — with a very low per-container threshold for finished products. The current effective date is November 2026, with a proposed delay that could move it to December 2026. The FDA has also intensified enforcement against unauthorized ENDS and nicotine-pouch products.

Why this matters for payments. Underwriting is tightening, not loosening. The merchants who stay paid get their documentation and product classification in order before the rules change — not after a flag or a fund hold. A payment workaround never fixes a regulatory problem. Represent the business accurately; solve legality with counsel, not with routing.

    4Licensing & Business Documentation

The underwriting package starts here. Every item the merchant can produce strengthens the underwriting conversation and shortens time-to-approval.

    5Product Documentation & SKU Audit

Audit every SKU individually — "CBD" is not a legal classification. The trail should run: product → ingredients → cannabinoid concentration → source → manufacturing process → intended use → labeling → claims → state legality → federal status.

    6Claims & Marketing Compliance

Disease and therapeutic claims are a leading trigger for FDA warning letters and processor termination. This section flags language that must be removed or substantiated.

Hard line — non-negotiable. KJ ProWeb does not help merchants disguise a business to obtain processing. Concealed billing descriptors, false MCCs, fictitious storefronts, or misrepresenting products to an acquirer are grounds to pause the engagement. Transparent representation is what makes the eDebit rail durable.

    7Financial & Processing History

Processors underwrite on history. Gather the numbers that tell the story of how the business actually runs.

    8Compliance Operations

Operational controls demonstrate to an acquirer that the business is run responsibly and is easier — and safer — to underwrite.

    9Website & Checkout Compliance

The public storefront is the first thing an underwriter reviews. It must match the merchant's documentation exactly.

    10Payment Stack Diversification

The merchants who get wrecked depend on a single processor. A resilient merchant runs a stack — a primary rail, a secondary, and an operational fallback — so one policy change never takes them offline.

Why eDebit / pay-by-bank fits these verticals. Lower cost (no card interchange, escaping the 5–10% high-risk card bracket); fewer chargebacks; subscription reliability (bank accounts don't expire and reissue like cards, cutting involuntary churn); faster same-day/next-day funding; and honest, fast underwriting when representation is accurate and docs are clean.

    11Scoring & Readiness Rating

Tally the Yes / No responses from Sections 3–10 (exclude N/A). The readiness rating is a payment/underwriting judgment — not a legal determination.

    SectionApplicableYesNo% Yes

    11.2  Readiness rating (select one)

Automatic red-line failures (force 🔴 regardless of score): reliance on "under 0.3% Delta-9" alone with unresolved total-THC/THCA exposure for Nov/Dec 2026; prohibited disease/therapeutic claims still live in marketing; any attempt to disguise the business, descriptor, or MCC to obtain processing; nicotine/ENDS products sold without FDA authorization / valid PMTA status.

    12Action Plan & eDebit Recommendation

Translate the findings into next steps. Prioritize red-line items first, then documentation gaps, then stack diversification.

Important Disclaimer — Payment / Compliance-Readiness Review — Not Legal Advice

This Merchant Payment Readiness Assessment & Compliance Audit is a payment- and compliance-readiness review prepared by KJ ProWeb to help a merchant evaluate its documentation, product representation, and payment infrastructure. It is not legal advice and does not constitute a legal opinion on the lawfulness of any product, business model, or transaction.

The federal regulatory treatment of hemp-derived cannabinoids is changing rapidly. Changes to the federal hemp definition are scheduled to take effect in November 2026, with a proposed delay that could move the effective date to December 2026; total-THC (including THCA) calculations and per-container thresholds may reclassify products that are lawful today. FDA enforcement against unauthorized ENDS, nicotine-pouch, and cannabinoid products is also evolving. Before making any definitive legality decision, the merchant should engage qualified hemp/cannabis and/or FDA regulatory counsel to evaluate its specific products and states of operation, and should verify the final effective date and implementing details.

Card-network and acquiring-bank acceptance is a separate question from product legality; state legality does not guarantee card-network acceptance. Payment approval depends on each processor's and bank's own underwriting. KJ ProWeb does not assist any merchant in misrepresenting or disguising its business to obtain payment processing. A payment solution never resolves an underlying regulatory problem.
